Terms of service

Last updated

These terms are the agreement between you and Happier Forms (“we”, “us”) when you use happierforms.com. By creating an account or using the service you agree to them. If you use Happier Forms for a company, you agree on its behalf.

The service

Happier Forms lets you build forms, publish them, collect submissions and deliver those submissions to other tools you connect. We may add, change or remove features over time. If we remove something a paid plan depends on, we will tell you first.

Your account

  • You must be at least 16 and give us accurate sign-up details.
  • Keep your sign-in secure. You are responsible for what happens in your account and workspace, including what your team members do.
  • Tell us at [email protected] if you think someone else has got into your account.

Plans and billing

Free. Costs nothing. It includes unlimited forms and submissions with the limits shown on the pricing page, such as a daily cap on AI form builds. We may change Free plan limits.

Pro. $39 per workspace per month, or the yearly price shown on the pricing page, plus any taxes. Pro is billed in advance through Stripe and renews automatically each month or year until you cancel.

  • You can cancel any time from Billing in your workspace. Pro stays active until the end of the period you have paid for, then the workspace moves to Free. We do not refund partial periods unless the law requires it.
  • If a payment fails, we will email you and retry. If it still fails, the workspace may be moved to Free.
  • If we change Pro’s price, we will email workspace owners at least 30 days before the new price applies to them.

Your content

You own your forms, your prompts and the submissions you collect (“your content”). You give us permission to host, copy, process and send your content only as needed to run the service for you, including passing it to the tools you connect and the sub-processors listed in our privacy policy. We do not use your content to train AI models.

You are responsible for your content and for collecting it lawfully. If your forms collect personal data, you must tell respondents how you use it and have a legal basis to collect it. Do not use Happier Forms to collect card numbers, passwords, or health data that is regulated (for example under HIPAA).

Acceptable use

Do not use Happier Forms to:

  • phish, impersonate others, or collect sign-in details for other services;
  • send spam or deliver submissions to people who did not ask for them;
  • host illegal content, malware, or content that harasses or exploits others;
  • break the law or the rights of others, including privacy and intellectual property;
  • probe, overload or attack our systems, or get around plan limits or other technical limits.

We may take down a form or suspend a workspace that breaks these rules. Where we can, we will tell you first and give you a chance to fix it.

Connected tools

When you connect Slack, Google, Notion, HubSpot or another tool, your use of that tool is covered by its own terms. We are not responsible for outside tools, their outages, or changes they make that stop a delivery from working. We will show failed deliveries in your workspace so you can see and retry them.

AI features

The form builder and AI steps use an AI model to produce forms and text. AI output can be wrong. Check a form before you publish it and check what an AI step produces before you rely on it.

Ending the agreement

You can stop using Happier Forms and delete your workspace at any time. We may end or suspend your access if you seriously or repeatedly break these terms, or if we have to by law. If we shut down the service, we will give at least 30 days’ notice so you can export your forms and submissions.

No warranty

We work hard to keep Happier Forms running and your data safe, but the service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.

Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or $100 if you are on the Free plan.

Changes to these terms

We may update these terms. If a change matters, we will update the date at the top and email workspace owners at least 30 days before it takes effect. If you keep using the service after that, the new terms apply.

Governing law

The governing law and the courts for disputes will be named here after legal review.
